HK - Clinical Negligence

Cosmetic surgery

There is an upward trend in claims arising out of cosmetic surgery treatments. A lot of cases involving cosmetic surgery negligence claims centre on the issue of whether or not the patient received informed consent prior to the procedure, outlining the potential benefits and the potential risks associated with the procedure. At Hay & Kilner we have acted for clients who have suffered disfigurement or scarring following a cosmetic procedure and where the treatment resulted in injury, such as damaged nerve ends.

Here is an example of one of our current cosmetic surgery claims:

Incorrect breast surgery

Hay & Kilner are acting for a client who suffered from breast asymmetry for which she was receiving treatment by way of a two stage surgical procedure provided by the NHS. Our client will allege that the second operation was carried out in a substandard manner. An incorrect type of implant was inserted into the affected breast and an implant was inserted into the unaffected breast without need. Our client will also allege that during a third revision surgery, a breast reduction was performed without consent. Our client continues to suffer from breast asymmetry and requires revision and scar reconstructive surgery.
