Hay & Kilner have acted for numerous clients who have complained of receiving negligent dental care. A claim can arise when a filling is performed in a substandard manner; or where a patient has experienced incorrect root canal treatment; extraction of the wrong tooth; delay in diagnosis; and failure to appropriately treat periodontal disease.
Here are some examples of the dental claims we have settled:
Failure to diagnose gum disease
Hay & Kilner successfully settled a claim on behalf of a client who alleged that he received substandard dental treatment from his dental practitioner for a period of over 14 years. As a consequence, gum disease from which he was suffering remained untreated which led to the development of Periodontitis, a serious inflammatory disease affecting gum tissue and bone in the mouth. Had appropriate advice been given to our client, conservative management would have prevented the development of Periodontitis. As a result, our client lost the majority of his teeth and required significant and expensive reconstructive dental work. He also continues to suffer pain and discomfort on a daily basis. Hay & Kilner successfully recovered £75,000 in damages for our client.
Failure to diagnose tooth decay
Hay & Kilner successfully settled a dental claim for £3,600, following substandard treatment provided at a dental practice. It was argued that the Dental Practitioner failed to appropriately interpret an X-ray which clearly demonstrated tooth decay. As a result of the decay being left untreated this progressed over a period of nine months. As a consequence, our client required root canal therapy treatment and a crown.
