Complications associated with laser eye surgery

Hay & Kilner successfully settled a claim for £14,500 on behalf of a client who suffered complications associated with corrective laser eye surgery. Our client alleged that there was a failure to inform him that deterioration of vision was a potential risk associated with the surgery. If our client had been aware of the risk, he would not have proceeded with the non-essential surgery. Our client also alleged that there was a failure to carry out tests prior to the surgery to establish whether he would in fact benefit from the procedure.

Failure to diagnose a brain tumor

Hay & Kilner are investigating a claim on behalf of a young man who had a history of debilitating and persisting headaches. Our client attended hospital and an incorrect diagnosis of migraine was made. It was successfully argued that a CT scan should have been undertaken urgently, which would have revealed the presence of a brain tumour.

Our client underwent emergency surgery to remove the tumour but developed loss of vision in both eyes, caused by the tumour placing pressure on his optic nerves. He is now registered blind. It was successfully argued that had our client received timely treatment he would have retained 70-80% of vision in both eyes and led a normal life.
