Private Client Seminar – Thursday 17 October 2019 – A murder we wrote: The darker side of estate planning

Inspired by all things murder mystery, our autumn Private Client Seminar explores the darker side of family life, where love, deceit and jealousy can come together to create a number of issues in lifetime planning and estate administration.

The seminar is set against the backdrop of a murder at a family gathering, following which the Private Client team are instructed by a plucky detective to advise on the motives of each of the murder suspects, based on what they have to gain (or lose) from the death in light of the deceased’s lifetime and estate planning.

The topics to be covered include:

  1. Challenging the validity of a Will;
  2. Claims under the Inheritance (Provision for Family and Dependents) Act 1975;
  3. Key principles of division of assets on divorce and pre and post nuptial agreements;
  4. The use of Trusts in asset protection, from divorce to care home fee planning;
  5. Gifts made by an Attorney under a Lasting Power of Attorney; and
  6. The rules of forfeiture on murder.

The seminar will also look at the Inheritance Tax issues which may arise in relation to the topics to be discussed, with a focus on some key elements around the Residence Nil Rate Band and Gifts with a Reservation of Benefit.
