Intellectual Property

iPad

For a growing number of businesses, the most important asset they have is their Intellectual Property (IP) and we recognise the significance of protecting that IP, just as other business assets would be protected.

We deal with all non-contentious areas of IP, as well as the whole range of disputes which can arise from the use, development and dissemination of IP including:

  • Claims relating to products, software, designs and brands;
  • Claims for infringement of copyright, trademarks, patents, unregistered/registered design rights and Community design rights;
  • Claims relating to confidential information;
  • Injunctions; and
  • Disputed domain names.

As well as disputes, we also advise on all aspects of using and developing Intellectual Property including:

  • Development agreements;
  • Sales and purchases;
  • On-line trading;
  • The creation of new websites/branding;
  • Software licensing;
  • Franchise agreements; and
  • Patent transfers.

We provide a full service in terms of Intellectual Property rights and have successfully negotiated to protect, utilise and defend Intellectual Property for our clients. We are very experienced in the negotiation of commercial contracts where Intellectual Property can be the central issue or one of many considerations. Similarly, we act quickly and appropriately to protect clients’ Intellectual Property rights if they may be at risk of infringement.
