Workplace Covid testing: what you need to know

Workplace Covid testing is now being offered to businesses with more than 50 employees and the Health Secretary has urged businesses to take up this offer. However, prior to introducing testing, employers need to carefully consider the employment law and data protection implications.

We are currently advising employers in relation to the steps which should be taken in advance of implementing testing, including consideration of what steps can be taken if individual employees refuse to undergo workplace testing and the potential consequences of disciplinary action and/or withholding pay. Likewise we are advising employers in relation to the steps that should be taken if they plan to require vaccination against Covid and the options available to them if employees refuse to be vaccinated for non-medical reasons.
