Workplace Covid testing is now being offered to all businesses in England, including those with fewer than 50 employees. The lateral flow tests are free until 30 June and companies can register until 31 March.
Prior to introducing testing, employers need to carefully consider the employment law and data protection implications. We are currently advising employers in relation to the steps which should be taken in advance of implementing testing, including consideration of what steps can be taken if individual employees refuse to undergo workplace testing and the potential consequences of disciplinary action and/or withholding pay.
Likewise we are advising employers in relation to the steps that should be taken if they plan to mandate vaccination against Covid and the options available to them if employees refuse to be vaccinated for non-medical reasons.
We are also supporting employers who do not wish to mandate vaccination by providing policies which encourage employees to be vaccinated.
