If you have 10 or more employees and cannot provide testing in the workplace, you can now order free rapid lateral flow tests for your employees to use at home twice a week. Employers must register by 12 April and it is on the condition that your employees cannot work from home. Prior to introducing testing, employers need to carefully consider any employment law and data protection implications, including consideration of what steps can be taken if individual employees refuse to undergo workplace testing and the potential consequences of disciplinary action and/or withholding pay.
It has recently been reported that the Health Secretary is considering legislation which would require care workers to be vaccinated against COVID. We are currently advising a number of employers in relation to the steps that should be taken if they plan to mandate vaccination against Covid and the options available to them if employees refuse to be vaccinated for non-medical reasons.
A poll of over 1,000 employers, carried out by the TUC, found that only 45% had committed to offering their employees paid leave to attend vaccination appointments.
