Advising the Elderly

Legal issues affecting older and vulnerable people and their families can often be complex and challenging.

Our team advise elderly clients in relation to Wills, Trusts and lifetime giving for Inheritance Tax purposes in order to meet the needs of our clients during their ‘golden years’.

We also work with clients to ensure provision is made for their future care needs and provide advice in relation to issues surrounding mental capacity. Our work in this area includes preparing Property and Financial Affairs, Lasting Powers of Attorney and Health and Welfare Lasting Powers of Attorney. We also work with clients in making applications to the Office of the Public Guardian for the registration of Enduring Powers of Attorney and advise clients in relation to advanced decisions to refuse medical treatment, which are often more commonly known as Living Wills.

In circumstances where a client’s mental capacity has already become an issue, we work with family members in applying to the Court of Protection when that client is no longer able to manage their own affairs in order to ensure that everyone involved in their care is working in the client’s best interests. We also work with family members in making applications for Statutory Wills where a client no longer has the capacity to make a Will themselves.
