Kate Fenwick

Kate is a barrister and Head of Private Family. She has over a decade of experience as a specialist family law barrister. She has been consistently recognised as a Leading Junior in family law in both Legal 500 and Chambers & Partners, and sits as a Deputy District Judge in both the civil and family jurisdictions.

Overview

Her financial remedy practice covers complex and high value cases involving business assets, trust interests and corporate valuations, underpinned by formal training in financial valuation by Harvard Law School. Kate also handles fact-sensitive children disputes, including those involving domestic abuse, coercive and controlling behaviour, allegations of alienating behaviours and applications for the relocation of children, often with cross-border and offshore elements. Kate spent a year practising offshore in Bermuda, working on UHNW commercial disputes. Kate is known for meticulous preparation, robust advocacy and a calm, approachable manner with clients at the most difficult moments in their lives, and is a committed advocate of non-court dispute resolution.

Key Experience

  • Successfully represented the Applicant in obtaining the Court's permission to relocate the children internally. Following cross-examination at a contested hearing, Kate persuaded the Court to depart from the recommendation of Cafcass that the children should not relocate.
  • Successfully represented the Respondent in resisting urgent applications preventing the international movement of the children of the family.
  • Successfully represented a party seeking injunctions to restrain publicity in the High Court.
  • Successfully represented a Respondent defending multiple allegations of rape and serious sexual abuse.
  • Successfully represented a Local Authority in obtaining findings of serious sexual abuse of a non-verbal and profoundly disabled child.
  • Successful representation of the Applicant in an application for Notice to Show Cause why the terms of a Pre-Nuptial Agreement should not be upheld.
